1. About the Platform and Service Provider Identity

MarketplaceKit is an online platform that allows users to post rental listings and contact other users to rent equipment. The platform acts solely as an intermediary connecting users.

By using the platform, you accept these terms of service in full. If you disagree with any part of these terms, please do not use the platform.

2. Registration and Account

To use certain platform features, registration is required. When registering, you must:

• Be at least 18 years old — the platform is not intended for minors
• Provide accurate and complete information
• Maintain the security of your account and password
• Immediately notify us of any unauthorized use of your account
• Not share access credentials with third parties

By registering, you confirm you are of legal age and accept these terms. We reserve the right to remove or suspend an account without prior notice in case of violation.

3. Posting Listings

Users who post listings guarantee that:

• They have the right to rent the equipment they advertise
• The equipment is in working condition and safe to use
• The description and photos accurately represent the equipment
• The listed prices are accurate and up to date
• The listing does not infringe third-party rights

It is prohibited to post listings for equipment that is illegal, dangerous, stolen, or whose rental violates applicable laws.

4. Equipment Rental

The platform enables communication between equipment owners and potential users. All rental agreements, including:

• Price and payment method
• Deposit and its return
• Pickup and return schedule
• Equipment condition
• Liability for damage

...are the sole responsibility of the users participating in the transaction. We recommend written documentation of all agreements and photographing equipment before pickup.

5. Limitation of Liability

MarketplaceKit does not participate in transactions between users and is not responsible for:

• Quality, safety, or legality of the advertised equipment
• Accuracy of information in listings
• Ability of users to complete the transaction
• Damage caused by use of rented equipment
• Disputes between users
• Loss, theft, or damage to equipment

The platform is provided as-is without any warranties. We do not guarantee uninterrupted or error-free operation of the platform.

6. Prohibited Conduct

The following are prohibited:

• Posting false or misleading information
• Using the platform for illegal activities
• Harassing or threatening other users
• Attempting fraud or theft
• Automated scraping of platform data
• Disrupting normal platform operation
• Creating multiple accounts to abuse the system
• Sending spam messages to other users
• Posting URL links in listing descriptions
• Using others' photos without permission or photos with watermarks from other platforms

7. Prohibited Rental Items

The following items may not be listed:

• Weapons, ammunition, and pyrotechnic devices (except professional equipment with permits)
• Stolen or illegally obtained equipment
• Drugs, narcotics, and equipment for their production or use
• Medical equipment requiring special permits
• Equipment that infringes copyright (pirated software, copies)
• Vehicles without valid registration and insurance
• Gambling equipment without a license
• Pornographic content and sexual aids
• Personal documents, credit cards, and financial instruments
• Animals

Listings that violate these rules will be removed, and the user's account may be suspended.

8. Content Moderation and Reports

We reserve the right to moderate content on the platform:

• Reporting listings: Users can report listings that violate the rules. Reports are processed within 48 hours.
• Content removal: We may remove listings, messages, or other content that violates these terms without prior notice.
• Actions against users: In case of rule violations, we may issue a warning, temporarily suspend an account, or permanently block a user.

Blocked users are not entitled to compensation for unavailability of platform services.

9. Intellectual Property

All content on the platform, including the logo, design, text, and software, is the property of MarketplaceKit or its partners. Use of this content without explicit permission is prohibited.

Users retain rights to content they post, but grant the platform a non-exclusive, royalty-free license to:

• Display content on the platform
• Share on social media (Facebook, Instagram)
• Use for promotional purposes of the platform

By uploading photos, you confirm you have the right to use them. Using others' photos without the owner's permission is prohibited.

10. Indemnification

By using the platform, you agree to indemnify and hold MarketplaceKit, its owners, partners, and employees harmless from any claims, damages, losses, costs, or expenses (including attorney fees) arising from:

• Your violation of these terms of service
• Your violation of third-party rights
• Illegal activities through your account
• Damage arising from transactions you participated in

11. Account and Data Deletion

You may request deletion of your account at any time through profile settings or by contacting support.

After account deletion:

• Your listings will be removed from the platform
• Account data will be deleted within 30 days
• Messages and reservations are retained for 2-3 years for legal reasons
• Ratings you gave or received remain anonymized on the platform

Accounts inactive for more than 24 months may be automatically deleted.

12. Changes to Terms

We reserve the right to modify these terms of service at any time. We will notify users of significant changes via the platform or email at least 7 days in advance. Continued use of the platform after changes constitutes acceptance of the new terms.

13. Dispute Resolution

These terms are governed by applicable law. For all disputes arising from the use of the platform, the competent courts of the applicable jurisdiction shall have authority.

We encourage users to first attempt to resolve disputes amicably through direct communication with the other party. If that fails, you may contact us for assistance in mediation before initiating legal proceedings.
